Invoicing note

TrainerBjorn is the name under which training and services are offered. Quotations, agreements and invoices may therefore be issued in the name of DoGoDa.

2) Terms and conditions

2.1 Definitions

• DoGoDa: contractor, trading under the brand name TrainerBjorn.
• Client: natural person or legal entity that purchases a service.
• Services: (custom) training, in-company training, online sessions, coaching, exam preparation and related advisory services.
• Participant: person who actually participates in a training session.

2.2 Applicability

• These terms apply to all quotations, offers, assignments and agreements with DoGoDa.
• Deviations only apply if confirmed in writing by DoGoDa (email is sufficient).
• The client's purchasing conditions do not apply unless DoGoDa explicitly accepts them in writing.

2.3 Non-binding enquiries

• An enquiry, contact message, intake or expression of interest is entirely non-binding and creates no obligations for the client or DoGoDa.
• An agreement only comes into effect when DoGoDa confirms in writing that the assignment has been accepted, including scope, date(s) (if applicable) and pricing.

2.4 Quotations and formation of agreement

• Quotations are non-binding and valid for 30 days unless otherwise stated.
• Obvious errors or typos are not binding on DoGoDa.
• An agreement is formed when:
  1. the client accepts a quotation in writing, and
  2. DoGoDa confirms the assignment in writing.

2.5 Performance and best-efforts obligation

• DoGoDa performs services to the best of its knowledge and ability.
• Training and coaching constitute a best-efforts obligation; DoGoDa does not guarantee specific results or exam outcomes.
• DoGoDa may subcontract (parts of) work to third parties if necessary for proper performance.

2.6 Scheduling, location and prerequisites

• Dates and times are agreed in consultation.
• For in-company training, the client provides a suitable space and basic facilities (e.g. screen/whiteboard where needed, Wi-Fi, power outlets).
• For online training, the client is responsible for a stable connection and a working environment (audio/video).

2.7 Rates and payment

• Prices are exclusive of VAT unless otherwise stated.
• Invoices have a payment term of 14 days unless otherwise agreed in writing.
• In the event of late payment, DoGoDa may charge statutory (commercial) interest and reasonable collection costs.
• For larger assignments, DoGoDa may agree a deposit or partial invoicing in advance.

2.8 Cancellation and rescheduling

These arrangements apply to custom / in-company / 1-on-1 (DoGoDa does not offer open enrolment).

A) In-company or custom training (on-site or online)

• Rescheduling is free of charge up to 14 days before the start date (one-time, by mutual agreement).
• Cancellation:
  • up to 14 days in advance: free of charge
  • 14–7 days in advance: 50% of the agreed amount
  • < 7 days in advance: 100% of the agreed amount

B) 1-on-1 sessions / coaching

• Rescheduling/cancellation is free of charge up to 48 hours in advance.
• Within 48 hours: 100% of the agreed rate.

2.9 Liability

• DoGoDa is not liable for indirect damages (consequential loss, loss of profit, missed savings).
• Liability is limited to the invoice amount of the relevant part of the assignment.
• This limitation does not apply in cases of intent or deliberate recklessness on the part of DoGoDa.

2.10 Intellectual property & use of materials

• All materials (slides, handouts, templates, exercises, code examples) remain the property of DoGoDa unless otherwise agreed in writing.
• The client/participant receives a non-exclusive, non-transferable right of use for internal learning purposes.
• It is not permitted to copy, publish, resell or offer materials as your own training without written permission.

2.11 Microsoft MCT, NDA and confidentiality

• DoGoDa/TrainerBjorn may provide training within the Microsoft ecosystem and (where relevant) the qualifications of a Microsoft Certified Trainer (MCT).
• DoGoDa does not share confidential or non-public Microsoft content and respects applicable NDAs, licences and terms of use.
• The client shall not ask DoGoDa to provide material or information that conflicts with NDAs, licences or confidentiality.

2.12 Confidentiality (client information)

• Information about systems, data, processes or business operations shared during the assignment is treated confidentially by DoGoDa.
• DoGoDa may reference a collaboration (e.g. "client case") without identifiable details, unless the client objects in writing.

2.13 Complaints

• Please submit complaints as soon as possible, no later than 14 days after discovery, by email.
• Both parties will make reasonable efforts to reach a solution.

2.14 Applicable law

• All agreements are governed by Dutch law.
• Disputes shall be submitted to the competent court in the district where DoGoDa is registered (Arnhem), unless mandatory law dictates otherwise.

3.1 What data do I process?

Depending on contact and assignment:

• Name, (business) email address
• Company name and invoicing details (where applicable)
• Communications (e.g. emails)
• Information you share in relation to your enquiry or assignment (e.g. learning goals)

3.2 What do I use this data for?

• To contact you and answer your questions
• To prepare quotations and carry out assignments
• For scheduling, delivery and follow-up of training sessions
• For administration and invoicing
• To use contact details of interested parties for responding to the initial enquiry and to potentially contact you later about future training opportunities that logically align with your interest

3.3 Sharing with third parties

DoGoDa does not sell or share your personal data with third parties. Exceptions apply only when strictly necessary for the performance of the agreement or to comply with legal obligations (e.g. accounting/tax), and only with appropriate safeguards.

3.4 Retention periods

• Emails/communications: retained in the mailbox as long as reasonably necessary for follow-up and relationship management
• Quotations and invoices: retained in the mailbox (and any administrative systems) as long as necessary for business operations and legal obligations, including the fiscal retention obligation (in practice typically 7 years for invoices/administration)

3.5 Security

DoGoDa takes appropriate measures to protect personal data, including access management and limiting access to data.

3.6 Your rights

You may request access to, correction or deletion of your data, and object to the use of your data for contacting you about future training opportunities. Email: bjorn@dogoda.nl.

3.7 Complaint

You may file a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
